The Trump’s Gaza peace plan should not have originated from the US. It has to have the approval of the UN General Assembly and the UN Security Council to ensure its compliance. I propose an alternative peace plan for the adoption of the UN.
The Alternative Gaza Peace Plan Including West Bank
- Palestine, comprising Gaza and West Bank, shall be an independent state. Every person either born in Gaza/West Bank or permanent resident of and/or domiciled in Gaza/West Bank on the date of formation of Palestine state shall be its citizen. However, the Hamas soldiers shall not be citizens of Palestine by default. They shall be accepted as citizens of Palestine only as mentioned in para 12 below. Israeli settlers in West Bank shall also not be the Palestine citizens by default. They shall be accepted as Palestine citizens only as mentioned in para 18 below.
- Israel shall immediately remove its forces from Gaza and ensure territorial status quo as of date in West Bank. The USA shall stand guarantor of the same. If the USA is unable to ensure it, it shall approach the UN Security Council to ensure the same by the use of force. If the USA fails to do it, any member state of the UN can approach the UN Security Council for the said purpose.
- The UN shall create an ad-hoc peace keeping force for maintaining peace in Gaza and West Bank for an initial period of six months, including ensuring seamless sourcing and distribution of international humanitarian aid in Gaza. Its personnel shall be stationed in Gaza and replace Israeli forces in Gaza. However, the said peace keeping force shall be mobile and shall also operate in West Bank as may be necessary.
- Israelis under the captivity of Hamas shall be immediately transferred to the said peace keeping force. Qatar shall stand guarantor of the same. If Qatar is unable to ensure it, it shall approach the UN Security Council to ensure the same by the use of force. If Qatar fails to do it, any member state of the UN can approach the UN Security Council for the said purpose.
- Palestine citizens shall elect a constituent assembly from among themselves through an election conducted by the UN in no more than three months from the date of declaration of independence. The UN shall set up an ad-hoc body for this purpose with representation from member states of the UN. The said body will prepare electoral rolls comprising adult voters of sound mind in Palestine, issue digital identity cards to all Palestine citizens, and carry out elections preferably using blockchain technology. The said blockchain, if set up, shall be transferred to the constituent assembly in due course. The constituent assembly, so set up, shall be granted an aid of USD 10 mn by the USA and Israel, jointly and severally, for managing its affairs. If the USA and/or Israel fail to provide the said grant, any member state of the UN can approach the UN Security Council for ensuring the grant by the use of force. The constituent assembly shall have the authority to appoint its secretarial and other staff from among Palestine citizens and foreigners.
- The constituent assembly, as its first agenda, shall decide the modalities of citizen exchange between Palestine and Israel. However, the modalities of citizen exchange shall not permit retention or detention of any Israeli citizen in Gaza, and they shall not be called prisoners. All Israeli citizens alive shall be handed over to Israeli government, and those deceased shall also be handed over to Israeli government in the most dignified manner possible respecting applicable religious practices.
- Similarly, Palestine citizens in the captivity of Israeli government, addressed by whatever name, shall be handed over to the constituent assembly without any reservations. Those deceased shall be handed over to the constituent assembly in the most dignified manner possible respecting applicable religious practices. It is clarified that Hamas soldiers, even though not recognized as Palestine citizens by default, shall be considered as Palestine citizens for the purpose of this exchange.
- The actual citizen exchange shall take place under the supervision of the said peace keeping force of the UN set up for maintaining peace in Gaza and West Bank.
- The constituent assembly, as its next agenda, shall assess the immediate humanitarian needs of Palestine citizens and set up a special purpose vehicle (SPV) for sourcing and provisioning of humanitarian aid to Palestine citizens. The SPV shall comprise Palestine citizens as well as international experts, as may be appointed by the constituent assembly. However, the final list of appointees shall be put to a referendum of the said electoral rolls of Palestine citizens and shall be notified only if passed with a simple majority. Once set up, all international humanitarian aid in Gaza shall be sourced and provisioned in Palestine through the said SPV only.
- The constituent assembly, as its next agenda, shall take up setting up of military and police forces for Palestine. The forces shall comprise Palestine citizens only. The selection of chiefs of the forces shall be made by the constituent assembly; however, their names shall be notified only if they have been passed by the said electoral rolls of Palestine citizens in a referendum by a simple majority. The Palestine forces shall be assisted by an ad-hoc peace keeping force of the UN set up for this specific purpose for the initial period of 3 years. The said ad-hoc peace keeping force shall replace the ad-hoc peace keeping force earlier set up to maintain peace in Gaza and West Bank.
- Once new organizational set up of forces has been formalized, Hamas shall hand over all its military infrastructure to the constituent assembly, who shall then apportion it among various forces set up in Palestine. Qatar shall stand guarantor to the said hand over. If Qatar is unable to ensure it, it shall approach the UN Security Council to ensure the same by the use of force. If Qatar fails to do it, any member state of the UN can approach the UN Security Council for the said purpose.
- Hamas soldiers shall be registered as citizens of Palestine and shall be subjected to Palestinian and international law like other citizens. However, they shall gain the citizenship status only after the military infrastructure has been so handed over to the constituent assembly.
- The constituent assembly, as its next agenda, shall assess the damage because of the Hamas-Israel war and formulate a plan for redevelopment of Gaza. It shall also setup a special purpose vehicle (SPV) for the purpose of Gaza redevelopment, which SPV shall have control over all resources including finances for the redevelopment of Gaza. The said SPV shall also have the authority to initiate judicial or other processes for obtaining war reparations from Israel and/or others. The SPV shall comprise Palestine citizens as well as international experts, as may appointed by the constituent assembly. However, the final list of appointees shall be put to a referendum of the said electoral rolls of Palestine citizens and shall be notified only if passed with a simple majority.
- The constituent assembly shall formalize a constitution for the governance of Palestine and adopt the decisions already taken as clauses two to five of the constitution and the first clause being the declaration of independence and definition of citizens.
- Once the constitution for the governance of Palestine has been set up, the constituent assembly shall conduct a referendum for ratification of the constitution by the said electoral rolls of Palestine citizens by a simple majority. The constitution shall become operational only after it has been so ratified.
- The constituent assembly shall then prepare a new electoral rolls of Palestine citizens including the newly registered Hamas soldiers and conduct the first election for the election of legislative assembly of Palestine in accordance with the constitution, and handover all operations to the newly elected legislative assembly, who would then ensure the formation of new government in accordance with the constitution. If the constitution doesn’t provide for elections and formation of the legislative assembly, the constituent assembly will hand over the operation to the newly formed government as laid down in the constitution. The constituent assembly shall cease to exist and operate thereafter.
- Once the new government for Palestine has been set up, Israel shall hand over the occupation and governance of West Bank to the new government so formed. The USA shall stand guarantor of the same. If the USA is unable to ensure it, it shall approach the UN Security Council to ensure the same by the use of force. If the USA fails to do it, any member state of the UN can approach the UN Security Council for the said purpose.
- The Israeli settlers in West Bank shall have the option of choosing Palestine citizenship subject to relinquishing Israeli citizenship. The intial registration of the settlers as citizens, if the option is exercised within one month from the date of formal handing over of the occupation and governance of West Bank, shall be temporary only, which shall be confirmed by the concerned authority in the Palestine state only after satisfying itself about the relinquishment of Israeli citizenship within a period of six months from the date of grant of temporary citizenship of Palestine. During this period, the settler shall have the option to reconsider his decision to opt for Palestine citizenship exercised by doing nothing.
