In Re: Fabindia and Smriti Irani

My Comment: Fabindia can’t escape the blame. This is like strict liability; i.e. when you bring a wild animal home as a pet, you are responsible for the lives of not only your visitors but the public at large. These CCTV cameras are worse because they have the potential of turning men into wild animals. I am surprised how this shop is not shut yet.

The Concept of Land Acquisition

The most important objective of acquisition of any land is to give a clear title of land to the State, which can then be transferred to the private entities — most of the agricultural land in India is Joint Family Property, which can never be transferred very clearly; so, the business prefers transfer of title through its acquisition by the State. This forced manipulation of ownership of land under the…

Conversion Debate

Article 25 of the Constitution provides free propagation of religion as a fundamental right. Both Christianity and Islam recognize conversion as a mode of propagation of religion. Hinduism being a purist religion doesn’t allow conversion into it; it only allows re-conversion after a process of shudhi. Any law on the lines of Gujarat’s “Freedom of Religion” law giving power to an executive magistrate to sit over the rights of people…

Lakshmi Trumps | Happy Diwali

Taking cue from the vibrant democracy in India, the three goddesses decided to contest the all women elections for positional superiority. Calcutta embraced the violence of Parvati/Durga/Kali, but the practical businessmen voted en masse for Laxmi; Saraswati, well…some remembered her too and marked a day sometime in January for by-elections. Madras is less violent so they replaced the violence of Durga with the knowledge of Saraswati on Vijaya Dashmi, but…

Many in the Indian Army have turned communal on the lines of RSS/BJP. 4. The Indian Army has denied involvement of any army personnel in the incident after an internal inquiry. 5. The boy was burned inside an army controlled area, where…

Whistleblower Protection In Re: Prashant Bhushan’s Advocacy

Prashant Bhushan’s advocacy in the SC in re. Ranjit Sinha’s case has brought in an interesting issue to the fore; i.e., what is the protection available to a whistleblower/informer of the commission of an offence when the information is made not to a police officer or a magistrate but to an advocate through his client? An advocate is an officer of the court but also has a duty towards his…

Privacy Protection In Re: Ranjit Sinha’s Investigation

Though I am writing it prematurely, I have a reason for doing it. This is because, as per media reports, Ranjit Sinha has raised a plea of infringement of his privacy. The facts are that a visitor entry register recording the entry of visitors to the CBI director’s home has been produced in the SC in a sealed envelope. Under normal circumstances, a home is an individual’s castle, and no…
